Products available directly through the Online Store can be purchased through checkout

These Terms and Conditions govern the commercial relationship between ROMA studio, a brand of NOVELO POSITIVO - UNIPESSOAL, LDA, and its customers, distinguishing between:

Online Store - products purchased directly through the ROMA studio online store;

Projects and Products by Quote - furniture, products and other projects handled individually through Project pages, forms, WhatsApp or direct contact with the ROMA studio team, including products with standard configurations and, where applicable, products or projects developed according to the customer’s specifications.

Any specific terms set out in a quotation, proposal or contract accepted by the customer supplement these Terms and shall prevail in relation to the specific characteristics and conditions of the relevant order or project, within the limits permitted by applicable law.

ROMA studio seeks to ensure that the information made available on the website is clear, accurate and up to date.

Photographs, images and representations of products are intended to reproduce their appearance as faithfully as possible. However, colours, textures and finishes may vary depending on the device, screen, lighting or viewing conditions.

Due to the use of natural materials and artisanal processes, slight variations in colour, grain, texture or finish may occur as an inherent characteristic of the material and production process, provided that such variations do not constitute a lack of conformity under applicable law.

The content made available on the ROMA studio website, including texts, photographs, images, videos, graphic elements, design, trademarks, logos and technical documentation, is protected by applicable intellectual property rights.

Except where permitted by law, reproduction, distribution, modification or commercial use of such content requires the prior authorisation of ROMA studio or the relevant rights holder.

Products available through the Online Store are presented with their essential characteristics, available options, price and other information relevant to the purchase.

Products available through the ROMA studio Online Store may be produced after the order has been confirmed (made to order) or may be in stock, as indicated on the relevant product page.

For made-to-order products, the current estimated production and preparation time before dispatch is up to 10 business days, unless otherwise indicated on the product page or during checkout.

For products in stock, a shorter preparation time before dispatch may apply, as indicated on the product page or during checkout.

These periods refer to the production and/or preparation of the order for dispatch and are separate from the transit time to the delivery destination.

The fact that a standard product is produced after an order is placed does not, in itself, mean that the product is personalised or automatically exclude any right of withdrawal applicable to consumers.

To make a purchase, the customer must select the desired product and available options, add the product to the cart and complete the checkout process.

Before confirming the order, the customer will be able to review the main information provided, the products selected, prices and applicable charges.

Once the order has been completed, a confirmation will be sent to the email address provided by the customer.

ROMA studio may decline or cancel an order where there is a legitimate reason to do so, including:
- inability to supply the product;
- ailure or inability to process payment;
- reasonable suspicion of fraud;
- a manifest error concerning the product, price or other essential elements of the order.

Where payment has already been received for an order subsequently cancelled by ROMA studio, the corresponding amount will be refunded in accordance with the applicable conditions.

Prices displayed in the Online Store are expressed in euros (€) unless otherwise indicated.

Applicable taxes are calculated in accordance with the tax regime applicable to the relevant transaction.

Shipping costs and any other charges that can reasonably be calculated in advance are presented to the customer before the order is completed.

Applicable tax documentation will be issued by NOVELO POSITIVO - UNIPESSOAL, LDA based on the information provided by the customer.

The customer is responsible for verifying the accuracy of the billing information provided.

The payment methods available are presented to the customer during checkout.

Availability may vary depending on the country, device or the conditions of the relevant payment service providers.

Payment will be processed in accordance with the method selected and the conditions presented during checkout.

The ROMA studio Online Store currently delivers to Portugal and selected countries within the European Union, according to the options available during checkout.

Deliveries to Madeira and the Azores are available and subject to specific shipping rates.

In Spain, the Canary Islands, Ceuta and Melilla are not currently covered by the Online Store delivery options.

Deliveries to countries outside the European Union are not available at this stage.

Applicable shipping costs are presented to the customer before the order is completed.

Estimated transit time is separate from the production and preparation period indicated on the product page or during checkout.

Delivery areas, shipping costs, estimated transit times, tracking and procedures relating to delays, loss or damage during transport are described in ROMA studio’s Shipping & Returns information.

Where a specific production or delivery period has been agreed or presented, that period will apply to the relevant order.

Where no different delivery period has been agreed, the time limits established by applicable law shall apply.

Where the purchaser acts as a consumer, they benefit from the statutory right of withdrawal in relation to eligible distance purchases, in accordance with applicable law.

The conditions relating to:
- the withdrawal period;
- return of products;
- return costs;
- condition of returned products;
- refunds;

are described in the ROMA studio Returns & Refunds Policy.

Projects and Products by Quote are handled through direct contact between the customer and ROMA studio and are not purchased through the standard Online Store checkout.

Submitting a form, sending a message or making another contact request constitutes a request for information or a quotation and does not, by itself, constitute the conclusion of a contract or confirmation of an order.

Depending on the product or project, specific conditions may be agreed in relation to:
- dimensions;
- materials;
- finishes;
- configuration;
- price;
- payment terms and schedule;
- production time;
- delivery;
- assembly or installation;
- other specific requirements.

The applicable conditions are set out in the relevant quotation, proposal or contract, where applicable.

An order or project handled by quote is considered confirmed in accordance with the acceptance conditions set out in the relevant quotation, proposal or contract.

Where changes are requested after confirmation, ROMA studio will assess their feasibility and, where applicable, communicate any resulting changes to price, timing or other conditions before implementation.

Specific cancellation conditions applicable to an order or project handled by quote may be set out in the relevant quotation, proposal or contract, without prejudice to any mandatory rights granted to consumers under applicable law.

The fact that a product is purchased by quote rather than through the Online Store checkout does not, in itself, mean that it is a personalised product or automatically exclude any applicable right of withdrawal.

Where the statutory consumer right of withdrawal applies, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised, except where otherwise agreed or where other circumstances provided for by law apply.

This exception does not affect any rights available under applicable law in the event of a defect or lack of conformity of the product.

Delivery and, where applicable, assembly or installation conditions for Projects and Products by Quote are determined according to the relevant order or project and may be specified in the quotation, proposal or contract.

These conditions are separate from the general shipping rules applicable to products purchased directly through the Online Store.

Where the provision of a service is subject to specific legal requirements, the corresponding statutory provisions shall apply.

Where the customer acts as a consumer, eligible goods benefit from the rights provided under Portuguese law concerning the conformity of goods.

For consumer movable goods covered by Decree-Law No. 84/2021, the seller is liable for any lack of conformity that becomes apparent within three years from delivery of the goods.

Subject to the conditions established by applicable law, the consumer may be entitled to repair or replacement of the goods and, where legally applicable, a proportionate reduction in price or termination of the contract.

Any additional commercial guarantee that may be provided by ROMA studio does not limit or replace the consumer’s statutory rights.

To report a possible defect or lack of conformity, the customer should contact ROMA studio and provide sufficient information to identify the purchase or project and allow the situation to be assessed.

The processing of personal data through the website, forms, Online Store and other channels used by ROMA studio is described in the Privacy Policy.

The e-commerce and checkout components of the Online Store use services provided by Shopify. In this context, Shopify collects and processes certain personal data relating to the use of the Online Store and purchases made through it.

ROMA studio uses Shopify features associated with Shopify Network Intelligence, through which Shopify may process data relating to customers’ interactions with ROMA studio, Shopify and other Shopify merchants in order to provide and improve certain services, including personalisation, analytics, security, fraud prevention and, where applicable, advertising.

In order to provide these services, certain information may be shared with Shopify and other service providers involved, including parties located in countries other than the country in which the customer is located.

ROMA studio provides access to the Portuguese Electronic Complaints Book (Livro de Reclamações Eletrónico) through the official platform:

In accordance with applicable law, consumers have access to Alternative Dispute Resolution mechanisms for consumer disputes (ADR).

Where applicable, ROMA studio provides information regarding the ADR entities to which it is bound by membership or legal requirement, together with the relevant websites.

The competent ADR entity may depend on the nature and circumstances of the contract.

The official and up-to-date list of Alternative Dispute Resolution entities may be consulted through the Portuguese Directorate-General for Consumer Affairs (Direção-Geral do Consumidor) – www.consumidor.gov.pt.

ROMA studio may update these Terms and Conditions where necessary to reflect changes in legislation, operations or the services offered.

Any changes will not affect rights already acquired in relation to contracts previously concluded or exclude the application of mandatory provisions of law.
